One-Year Limited Warranty

Limited Warranty

Bedrosians® warrants to its immediate and direct Purchaser, and no other person, that MANUFACTURED FIRST CHOICE QUALITY products will be free from defect for a period of one-year from date of purchase. This warranty only applies to installations made by duly and properly licensed and active tile contractors. Defect is defined as a shortfall in the product to perform to specifications as disclosed in product literature, within industry allowable tolerances as set forth by the Tile Council of North America (TCNA), the American National Standard Institute (ANSI), and the Marble Institute of America. This warranty is the sole warranty provided by Bedrosians® to its direct Purchasers and replaces any statutory warranties to the maximum extent allowable by law. It is the direct Purchaser’s responsibility to inspect all product prior to installation. Visual defects or nonconformities reasonably apparent, that direct Purchaser knows of or should know of, prior to installation void this warranty as installation is deemed acceptance of product.

This warranty covers only the following:

  1. Immediate and direct Purchaser from Bedrosians®, as evidenced by an invoice.
  2. Immediate and direct purchases of FIRST QUALITY products paid for in full, as evidenced by an invoice.
  3. Performance of the product only and not installation of product.
  4. Products installed by duly and properly licensed and active tile contractors.

Exclusions from Warranty

Certain factors are beyond our control, including installation of our products by others, building structural design or construction conditions, and environmental conditions. This warranty excludes any problems or occurrences caused or arising from the following, but not limited to:

  1. Improper installation, installation defects or errors, fabrication defects or errors, or improper transportation and handling of the products;
  2. Improper outdoor use of product;
  3. Improper commercial use of the product;
  4. Installation by an unlicensed, inactive, or improperly licensed tile contractor;
  5. Installation of any incorrectly sized, colored, shaded, calibrated, matched, or packaged product;
  6. Customer or contractor improper use or maintenance of the product including negligence, physical, or chemical abuse;
  7. Ordinary wear and tear;
  8. Normal variations between field tile and trim tile;
  9. Normal design, shade, or color variation from samples, website, or other illustrations;
  10. Grout-related problems, including but not limited to, shade variation, discoloration, deterioration, staining, hazing, or mildew;
  11. Any act or omission which might be reasonably expected to damage the product, including but not limited to, exposure to extreme temperature, wet-dry cycles, heat or fire, and appliances or furniture that would scratch the product;
  12. Any Commercial or Second quality products, or any products not classified as First Quality;
  13. Any natural stone products;
  14. Any labor charges for the removal of product or installation of replacement product.

Procedure for Making a Claim

  1. The immediate and direct Purchaser must provide Bedrosians® notice of any warranty claim within thirty (30) days of alleged defect discovery for warranty to potentially apply. The immediate and direct Purchaser’s failure to file a claim within the warranty period shall be deemed to act as a waiver and time bar for any and all warranty-related claims against Bedrosians®.
  2. Written notice must be sent by email to [email protected] with proof of purchase by means of invoice, photographs of the product, and photographs of the labeled boxes the product was received in. Failure to provide such documentation may result in denial of any warranty claim.
  3. If the product has already been installed, the direct Purchaser must provide jobsite access to a Bedrosians® representative and/or industry expert to complete a Job Inspection Report and photograph the installation. Purchaser must provide Bedrosians® the contractor’s name, license number, and contact information.

What Will Bedrosians Do?

  1. Bedrosians® or an authorized representative may schedule a jobsite visit to inspect and/or test the product, photograph the installation, and complete a report. Bedrosians® reserves the right to inspect any and all alleged defects prior to any repair, remediation, or settlement of any defect. All original packaging materials must be kept until after inspection. In the event the Purchaser fails to timely notify Bedrosians®, or fails to allow Bedrosians® the right of inspection, discussion or decision making in advance of repair, remediation or settlement of any defect, this warranty will be rendered void in its entirety.
  2. Our Product Warranty Department will evaluate information collected for every claim.
  3. Upon making a determination of the claim, Bedrosians® will notify the Purchaser in writing. Bedrosians® reserves the right to repair or replace the originally purchased product or refund the purchase price.

Limitation of Liability

If a defect in materials is discovered within the one-year period and a remedy is not available, the liability of Bedrosians® under any theory of liability, whether contract, tort, strict liability, or otherwise, shall be solely and exclusively limited to the replacement of defective goods F.O.B. Bedrosians®’ facility or, at Bedrosians®’ option, refund of the purchase price of such defective goods. IN NO EVENT SHALL BEDROSIANS®’ LIABILITY UNDER ANY CLAIM MADE BY PURCHASER EXCEED THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT OF WHICH DAMAGES ARE CLAIMED. Bedrosians® disclaims all express warranties not contained in this warranty. No agent, employee, or representative of Bedrosians® or any installer, dealer, agent, builder, designer, or manufacturer has any authority to alter or modify the obligations or limitations of this warranty. Any representations made in connection with the sale of this product that differs from the terms of this warranty are not valid and should be brought to the attention of Bedrosians® immediately (1-800-760-TILE).

IN NO EVENT SHALL BEDROSIANS® BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, LOSS OF USE, OR OTHER DAMAGES BY REASON OF ANY BREACH OF WARRANTY, IMPROPER INSTALLATION, MAINTENANCE, OR USE OF THE PRODUCT OR ANY DELAY OR FAILURE IN DELIVERY, WHETHER OR NOT BEDROSIANS® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Disclaimer

Tile is subject to variation in technical specifications, including COF,due to inherent variability in the raw materials and production process. Express technical specifications are not guarantees of minimum or maximum thresholds of performance. Unless specifically stated otherwise, tile recommended for floor or wall applications refers to interior applications only. Bedrosians® does not recommend its products for use on ceilings or roofs. Local building codes may dictate minimum tile performance specifications. Bedrosians® does not warrant product installations that violate building codes. Photographic color images may not be an exact product match. Buyer is to verify color, shade, caliber and texture with current and available stock on hand prior to purchase or installation. Installation constitutes acceptance.

Polished porcelain tile and glazed polished porcelain tile must be sealed prior to grouting and the grout color must match the predominant color of the tile.

Natural stone products are quarried from natural formations, rather than made at a factory. No two pieces are alike and there are inherent variances in all stone. Because these products are not subject to a manufacturing process, quality warranties are limited to the specified representations in product literature and guidelines established by the Marble Institute of America. Bedrosians® does not warrant natural stone products for shade, size, thickness, warping, cleft variations, veining, surface finish variations, or other natural variations.

Implied Warranties Limited in Duration

Any implied warranty applicable to the product sale, including the implied warranty of merchantability or the implied warranty of fitness for a particular purpose is limited in duration to the duration of this written warranty or the maximum statutory period, whichever is less. Some states do not allow limitations on implied warranty duration, so the above limitation may not apply to you. The Federal Magnuson-Moss Warranty Act limits disclaimers of implied warranties involving consumer products.To the maximum extent allowable by federal and state law, this warranty supplements or supersedes federal and state consumer goods warranty protections.

Implied Warranty of Fitness for a Particular Purpose

Bedrosians® may provide information in its product literature with regard to appropriate tile and stone applications. In these specified applications, Bedrosians® limits the duration of the implied warranty of fitness for a particular purpose to one-year or the maximum statutory period prescribed by law which ever is less. Failure to comply with recommended applications voids this warranty.

California Legal Notice

Tile and installation products contain chemicals known to the state of California to cause cancer, birth defects, reproductive harm, respiratory harm or other health problems. For more product-specific information on chemical content, contact Bedrosians® at 800-760-TILE.

Magnifica Warranty

10 YEAR LIMITED WARRANTY

Bedrosians® Tile & Stone (“Bedrosians®”) warrants to its immediate and direct customer (“Purchaser”), and no other person, that Magnifica® 12mm and 2cm 60”x126” or 60”x127” porcelain panels (“Product”) shall be free from material manufacturing defects under normal use and service, for a period of ten (10) years from the date of purchase from Bedrosians®, as evidenced by the original invoice. This non-transferrable warranty only applies where (1) the product is fabricated and installed by a duly and actively licensed fabricator and installer who has completed an ANSI specified qualification program; (2) the Product is installed in accordance with the Tile Council of North America (TCNA) handbook guidelines, ANSI A108.19 installation standards, and all of the Manufacturer’s written instructions; (3) the Product is used for its intended purpose, permanently installed in an appropriate application, not moved from its original installation and; (4) the Product is properly cared for and maintained.

NO REGISTRATION

No registration is required, however, proof of purchase must be evidenced by the original invoice and the Magnifica® panel identification information/serial number must be intact. This warranty does not apply to any other products, including other sizes, thicknesses, or porcelain panel products supplied by any other party or under any other name except Magnifica® by Bedrosians® in the 12mm and 2cm thickness and 60”x126” or 60”x127” size. All invoices for the Magnifica® slabs must be paid for in full or the warranty is void in its entirety. This warranty does not cover products received gratis, or free of charge.

DISCLAIMER

Merchandising materials and product samples are representative of a product’s potential characteristics and should be used for general reference only. Tile by its nature is subject to variations in color, shade, grain, sizing, movement, surface texture and finish. Such variations do not constitute a defect. Tile is subject to variation in technical specifications, including DCOF, due to inherent variability in the raw materials and production process. Express technical specifications are not guarantees of minimum or maximum thresholds of performance. We reserve the right to make changes to product specifications at any time without notice. It is the sole duty and onus of the Purchaser and/or End User to inspect and approve all Magnifica® panels upon receipt and prior to fabrication and installation. Any damage to the product caused by improper handling, fabrication, installation and/or care and maintenance is not the responsibility of Bedrosians®. If, during initial inspection, the Purchaser and/or End User is not satisfied or finds fault with the Magnifica® slab, the product should NOT be fabricated or installed. No agent, employee, or representative of Bedrosians® or any installer, dealer, agent, builder, designer, or manufacturer has any authority to alter or modify the obligations or limitations of this warranty. Any representations made in connection with the sale of this product, whether written or oral, that differs from the terms of this warranty are not valid and should be brought to the attention of Bedrosians® Product Warranty Department immediately by contacting [email protected].

EXCLUSIONS FROM WARRANTY

This warranty only covers manufacturing defects. Certain factors are beyond the control of Bedrosians®, including but not limited to fabrication or installation defects, mishandling, structural design, environmental conditions, chemical abuse, or general product abuse, none of which are covered by this warranty. Manufacturing defect is defined as a shortfall in the product to perform within manufacturer’s specifications and industry allowable tolerances as set forth by the Tile Council of North America (TCNA) and the American National Standard Institute.

Below are some, but not a complete list, of issues the warranty does not cover:

  1. Improper substrate preparation and flatness requirements;
  2. Seam performance and/or appearance, adhesives, caulk, or other accessory items. Once installed, the two main reasons for seam separation or cracking are thermal separation and shifting or movement of the substrate, cabinets or foundation;
  3. Improper seam placement, such as over a dishwasher or trash compactor;
  4. Alterations to the factory finish or slab thickness;
  5. Mishandling, misuse, physical/chemical abuse, or inappropriate use of cleaning solvents/products;
  6. Cracks or chips resulting from excessive pressure, impact, or loading applied from a person or object or inadequate radius on edges or corners;
  7. Normal “wear and tear”, normal fading, or discoloration;
  8. Improper maintenance and/or failure to follow porcelain tile care guidelines as provided on bedrosians.com;
  9. Defective or improper transportation, fabrication, installation, or workmanship;
  10. Variations in shade, color, pattern or shade distribution against the samples or merchandising materials;
  11. Exposure to excessive heat or thermal shock;
  12. Installation in vehicles, aircraft, or watercraft applications;
  13. Scratches or damage to the surface of the product after departure from a Bedrosians® facility. This material is highly scratch resistant but not scratch proof. Proper care must be exercised including the use of a cutting board as part of your care and maintenance;
  14. End User dissatisfaction with the color or surface finish of the Magnifica® panel(s) during or after fabrication and/or installation;
  15. Installation with insufficient expansion joints;
  16. Installation with improper or insufficient support, excessive deflection in the substrate, cabinets, structures, substrate, or sub-floors, causing failure;
  17. Chips or cracks that result from “dry” cutting or “dry” polishing;
  18. Damage to mitered edges or corners;
  19. Stains or markings caused by daily living or harsh chemicals;
  20. Insufficient bond coat application;
  21. Installation with aerosol adhesives or adhesives that discolor the product;
  22. Damage or injury caused by any act of God, natural disaster, vandalism, war, accidents, or site conditions.

PROCEDURE FOR MAKING A CLAIM

  1. The Purchaser must provide Bedrosians® prompt written notice within thirty (30) days of alleged defect discovery. The immediate and direct Purchaser’s failure to file a claim with complete information within thirty (30) days shall be deemed a waiver and time bar for any and all warrantyrelated claims against Bedrosians®. Written notice must be sent to [email protected] and must include:
    • Proof of purchase by means of an original Bedrosians® invoice;
    • Serial number of the slab with alleged defect;
    • Photographs of the slab under proper lighting;
    • Installer and/or fabricator’s name, license number, and phone number;
    • Installation date; and
    • Description of the claim
  2. Bedrosians® shall have the right to send a representative or third-party expert to inspect and photograph the product onsite, and to have samples of the product sent directly to the manufacturer or a testing facility. Bedrosians® reserves the right to inspect any and all alleged defects prior to any repair, remediation, or settlement of any defect. All original identifying information and labels must be kept intact until after inspection. In the event the Purchaser fails to timely notify Bedrosians® or fails to allow Bedrosians® the right of inspection, discussion or decision making in advance of repair, remediation or settlement of any defect, this warranty will be rendered void in its entirety. In the event Bedrosians® shall have the right to send a representative or third-party expert to inspect and photograph the product onsite, and to have samples of the product sent directly to the manufacturer or a testing facility. Bedrosians® reserves the right to inspect any and all alleged defects prior to any repair, remediation, or settlement of any defect. WHAT WILL BEDROSIANS® DO?

If or should any manufacturing defect become apparent during the limited warranty period, our Product Warranty Department will evaluate installation, care and maintenance information and photographs submitted and consult with the manufacturer. After assessing the claim, Bedrosians® will notify the Purchaser in writing. In the event of a manufacturing defect, Bedrosians® will replace the defective product with a product of equal value. If the product is replaced, exact color match is never guaranteed. If Bedrosians® cannot replace the product or such replacement is not commercially practicable, Bedrosians® may, at its sole option, refund the purchase price as reflected in the original Bedrosians® invoice. Labor charges for the fabrication, removal, or installation of the replacement product or any supplemental expenses are specifically excluded from this warranty. Bedrosians® shall have no liability for any loss, expense or damage resulting from the installation of Magnifica® panels.

LIMITATION OF LIABILITY

The liability of Bedrosians® under any theory of liability, whether contract, tort, strict liability, or otherwise, shall be solely and exclusively limited to the replacement of defective goods F.O.B. Bedrosians®’ facility or, at Bedrosians®’ option, refund of the purchase price of such defective goods. IN NO EVENT SHALL BEDROSIANS®’ LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT TO WHICH DAMAGES ARE CLAIMED. UNDER NO CIRCUMSTANCES SHALL BEDROSIANS® BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, LOSS OF USE, OR OTHER DAMAGES SUCH AS LOSS OF PROFITS, BUSINESS INTERRUPTION OR ANY OTHER LOSS, WHETHER OR NOT BEDROSIANS® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS LIMITED WARRANTY STATES THE SOLE AND EXCLUSIVE REMEDY OF PURCHASER AND THE SOLE AND EXCLUSIVE WARRANTY OF BEDROSIANS AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED BY STATUTE OR OTHERWISE, WHETHER OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR USE OR OTHERWISE, TO THE MAXIMUM EXTENT ALLOWABLE BY LAW.

California Legal Notice

Magnifica® panels can expose you to chemicals including crystalline silica (airborne particles of respirable size) in dust created during fabrication/installation only if the product is dry cut/ground or pulverized, which are known to the state of California to cause cancer. Choice of Law: This Limited Warranty shall be interpreted exclusively under the laws of the state of California

Effective Date: This Limited Warranty only applies to products purchased and installed after April 1, 2018.

Revera Warranty

25 Years Limited Warranty- Residential

Bedrosians® Tile & Stone (“Bedrosians®”) warrants to its immediate and direct customer (“Purchaser”), and no other person, that Revera™ engineered polished, velvet, and brushed products shall be free from material manufacturing defects under normal use and service, for a period of ten (25) years from the date of purchase from Bedrosians®, as evidenced by the original invoice. This nontransferrable warranty only applies where the product is installed by a duly and actively licensed fabricator/installer, installed according to industry standards as well as the Revera™ Installation Guide, used for the product’s intended purpose, permanently installed as an interior countertop, interior wall, interior shower wall, residential interior floor, or residential interior shower floor (velvet and brushed finish only) application, not moved from its original installation, and properly cared for and maintained in accordance with the Revera™ Care and Maintenance Guide. All Revera™ Installation, Care and Maintenance guidelines are available at www.bedrosians.com.

This warranty only applies to products sold and registered on or after November 1, 2015 with the Revera™ slab identification information intact. This warranty does not apply to any other products, including other quartz surfacing products supplied by any other party except Revera™ by Bedrosians®. All invoices for the Revera™ slabs must be paid for in full or the warranty is void in its entirety. This warranty does not cover products received gratis or free of charge.

This warranty only covers manufacturing defects, not installation defects or product abuse. Manufacturing defect is defined as a shortfall in the product to perform within manufacturer’s specifications and industry allowable tolerances as set forth by the Tile Council of North America (TCNA) and the American National Standard Institute (ANSI). Images and product samples are representative of a product’s potential characteristics. There is no guarantee the sample product or images will 100% match the product received. Engineered quartz is subject to variations in color, shade, grain, sizing, veining, movement, surface texture and finish. Such variations do not constitute a defect. We reserve the right to make changes to product specifications at any time without notice.

It is the sole duty and onus of the Purchaser and/or End User to inspect and approve all products upon receipt and prior to fabrication and installation. Any damage to the product thereafter is the responsibility of the Purchaser and/or End User. If, during initial inspection the Purchaser and/or End User believe the Revera™ slab possesses incorrect color/shading, finish, sizing, grading, gloss level, and/or any other characteristic, the product should NOT be installed. End User is responsible for ensuring proper fabrication, installation, application, care and maintenance of Revera™ slabs.

Exclusions from Warranty

Certain factors are beyond the control of Bedrosians®, including but not limited to transportation, fabrication, installation, building structure design, and environmental conditions.

  1. This limited warranty does not apply if Revera™ has been moved from its original installation location;
  2. This limited warranty does not cover Revera™ seam performance and/or appearance, adhesives, caulk, or other accessory items;
  3. This limited warranty is void if there is improper seam placement, such as over a dishwasher or trash compactor;
  4. This limited warranty does not cover alterations to the factory finish or slab thickness;
  5. This limited warranty does not cover mishandling, misuse, physical/chemical abuse, inappropriate use of cleaning solvents/products, or exposure to excessive moisture;
  6. This limited warranty does not cover fading or discoloration from exposure to ultra violet rays and/or light;
  7. This limited warranty does not cover cracks or chips resulting from excessive pressure or loading applied from a person or object;
  8. This limited warranty does not cover normal “wear and tear” or normal fading and discoloration;
  9. This limited warranty does not cover improper maintenance and/or failure to follow Revera™ Care and Maintenance Guide;
  10. This limited warranty does not cover defective or improper transportation, fabrication, installation, or workmanship by any person subsequent to receipt of product by the original Purchaser from a Bedrosians® facility;
  11. This limited warranty does not cover abnormal and/or creative use of material, including curving or bending;
  12. This limited warranty does not cover spots or blemishes inherent in the manufacturing process not effecting the structural stability of Revera™
  13. This limited warranty does not cover variations in shade, color, size, or pattern and shade distribution against the sample material, marketing displays, and/or printed illustrations;
  14. This limited warranty does not cover products exposed to excessive heat or thermal shock;
  15. This limited warranty does not cover products installed in any outdoor or exterior applications, including partially covered or sheltered outdoor areas. Exposure to weather, changing temperatures, sunlight and other conditions may damage the product;
  16. This limited warranty does not cover product installed to any outdoor applications;
  17. This limited warranty does not cover products installed in sink, steam shower, or steam room and sauna applications;
  18. This limited warranty does not cover products installed in vehicles, aircraft, or watercraft applications;
  19. This limited warranty does not cover scratches or damage to the surface of the product after the product leaves a Bedrosians® facility. This material is highly scratch resistant but not scratch proof. Proper care must be exercised including the use of a cutting board as part of your care and maintenance;
  20. This limited warranty does not cover End User dissatisfaction with the color or surface finish of Revera™ during or after installation;
  21. This limited warranty does not cover products installed with insufficient room for expansion;
  22. This limited warranty does not cover products directly secured with mechanical fasteners;
  23. This limited warranty does not cover products installed with improper or insufficient support, cabinets, structures, substrate, or sub-floors, causing failure;
  24. This limited warranty does not cover chips or cracks that result from “dry” cutting or polishing;
  25. This limited warranty does not cover mitered edges where the joint is not cut correctly;
  26. This limited warranty does not apply if the minimum requirements for edge detail were not followed;
  27. This limited warranty does not cover improperly cut joints;
  28. This limited warranty does not cover water marks, stains, or markings caused by daily living;
  29. This limited warranty does not cover products installed with aerosol catalyst adhesives;
  30. This limited warranty does not cover products installed with oil-based adhesives;
  31. This limited warranty does not cover damage or injury caused by any act of God, vandalism, war, accidents, or site conditions;
  32. This limited warranty does not cover any supplemental expenses incurred to repair or replace Revera™ including but not limited to electrical, plumbing, cabinetry, resurfacing, and tile or wall surface modification. Such repair and modifications shall be at the cost of the Revera™ End User. This limited warranty does not cover any other product used or installed whether or not in connection with Revera™;
  33. This limited warranty does not cover transportation, freight, tear-out, demolition in any form, disposal, reinstallation, fabrication, or associated costs beyond the cost of the product or its replacement;
  34. This limited warranty does not cover Revera™ product sold by unauthorized resellers or product sold by authorized resellers outside their authorized territory without the express written consent of Bedrosians®;
  35. This limited warranty does not apply if End User refuses to allow inspection of the alleged manufacturing defect by a Bedrosians® representative or, at Bedrosians®’ option, a thirdparty representative;
  36. This limited warranty does not cover improper selection of Revera™ for the installation or design, engineering, and construction of the installation site. Such determinations are strictly the End User’s responsibility

Procedure for Making a Claim:

  1. The Purchaser of Revera™ by Bedrosians® must register the product at www.bedrosians.com within thirty (30) days of the purchase date from Bedrosians® as indicated on the Bedrosians® invoice. Failure to register the product within the designated timeframe shall be deemed a waiver and time bar for any and all warranty-related claims against Bedrosians®.
  2. The Purchaser must provide Bedrosians® prompt written notice within ten (10) days of alleged defect discovery. The immediate and direct Purchaser’s failure to file a claim with complete information within ten (10) days shall be deemed a waiver and time bar for any and all warranty-related claims against Bedrosians®. Written notice must be sent to [email protected] and must include:
    • Proof of purchase by means of a Bedrosians® invoice;
    • Serial number of the slab with alleged defect;
    • Photographs of the slab under proper lighting;
    • Installer and/or fabricator’s name, license number, and phone number;
    • Installation date;
    • Description of the claim.
  3. Bedrosians® shall have the right to send a representative or third-party expert to inspect and photograph the product onsite and to have samples of the product sent directly to the manufacturer or a testing facility. Bedrosians® reserves the right to inspect any and all alleged defects prior to any repair, remediation, or settlement of any defect. All original identifying information and labels must be kept intact until after inspection. In the event the Purchaser fails to timely notify Bedrosians® or fails to allow Bedrosians® the right of inspection, discussion or decision making in advance of repair, remediation or settlement of any defect, this warranty will be rendered void in its entirety. In the event Purchaser and/or End User refuse to supply Bedrosians® with reasonably requested documentation, this warranty will be rendered void in its entirety.

What Will Bedrosians® Do?

If or should any manufacturing defect become apparent during the limited warranty period, our Product Warranty Department will evaluate installation information and photographs submitted. After assessing the claim, Bedrosians® will notify the Purchaser in writing. In the event of a manufacturing defect, Bedrosians® will replace the defective product with a product of equal value. If the product is replaced, exact color match is never guaranteed. If Bedrosians® cannot replace the product or such replacement is not commercially practicable, Bedrosians® may, at its sole option, refund the purchase price as reflected in the original invoice. Labor charges for the removal of product or installation of replacement product or any supplemental expenses are specifically excluded from this warranty. Bedrosians® shall have no liability for any loss, expense or damage resulting from the installation of Revera™ material.

The liability of Bedrosians® under any theory of liability, whether contract, tort, strict liability, or otherwise, shall be solely and exclusively limited to the replacement of defective goods F.O.B. Bedrosians®’ facility or, at Bedrosians®’ option, refund of the purchase price of such defective goods. IN NO EVENT SHALL BEDROSIANS®’ LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT TO WHICH DAMAGES ARE CLAIMED.

Bedrosians® disclaims all express warranties not contained in this warranty. This Limited Warranty is the sole warranty made by Bedrosians® for Revera™ surfaces. No agent, employee, or representative of Bedrosians® or any installer, dealer, agent, builder, designer, or manufacturer has any authority to alter or modify the obligations or limitations of this warranty. Any representations made in connection with the sale of this product, whether written or oral, that differs from the terms of this warranty are not valid and should be brought to the attention of Bedrosians® Warranty Department immediately by contacting [email protected].

UNDER NO CIRCUMSTANCES SHALL BEDROSIANS® BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, LOSS OF USE, OR OTHER DAMAGES SUCH AS LOSS OF PROFITS, BUSINESS INTERRUPTION OR ANY OTHER LOSS BY REASON OF ANY BREACH OF WARRANTY, IMPROPER INSTALLATION, MAINTENANCE, OR USE OF THE PRODUCT OR ANY DELAY OR FAILURE IN DELIVERY, WHETHER OR NOT BEDROSIANS® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Implied Warranties Limited in Duration

Any implied warranty applicable to the product sale, including the implied warranty of merchantability or the implied warranty of fitness for a particular purpose is limited to the duration of this written warranty or the maximum statutory period, whichever is less. Some states do not allow limitations on implied warranty duration, so the above limitation may not apply to you. The Federal Magnuson-Moss Warranty Act limits disclaimers of implied warranties involving consumer products. To the maximum extent allowable by federal and state law, this warranty supplements or supersedes federal and state consumer goods warranty protections.

Bedrosians® may provide information in its product literature with regard to appropriate quartz applications. Appropriate application for Revera™ is countertop, wall, shower wall, residential floor, or residential shower floor (velvet and brushed finish only). Interior applications only. In these specified applications, Bedrosians® limits the duration of the implied warranty of fitness for a particular purpose to ten (10) years or the maximum statutory period prescribed by law, whichever is less. Failure to comply with recommended installation, application, care and maintenance voids this warranty.

15 Years Limited Warranty - Commercial

Bedrosians® Tile & Stone (“Bedrosians®”) warrants to its immediate and direct customer (“Purchaser”), and no other person, that Revera™ engineered polished, velvet, and brushed products shall be free from material manufacturing defects under normal use and service, for a period of ten (15) years from the date of purchase from Bedrosians®, as evidenced by the original invoice. This nontransferrable warranty only applies where the product is installed by a duly and actively licensed fabricator/installer, installed according to industry standards as well as the Revera™ Installation Guide, used for the product’s intended purpose, permanently installed as an interior countertop, interior wall, interior shower wall, residential interior floor, or residential interior shower floor (velvet and brushed finish only) application, not moved from its original installation, and properly cared for and maintained in accordance with the Revera™ Care and Maintenance Guide. All Revera™ Installation, Care and Maintenance guidelines are available at www.bedrosians.com.

This warranty only applies to products sold and registered on or after November 1, 2015 with the Revera™ slab identification information intact. This warranty does not apply to any other products, including other quartz surfacing products supplied by any other party except Revera™ by Bedrosians®. All invoices for the Revera™ slabs must be paid for in full or the warranty is void in its entirety. This warranty does not cover products received gratis or free of charge.

This warranty only covers manufacturing defects, not installation defects or product abuse. Manufacturing defect is defined as a shortfall in the product to perform within manufacturer’s specifications and industry allowable tolerances as set forth by the Tile Council of North America (TCNA) and the American National Standard Institute (ANSI). Images and product samples are representative of a product’s potential characteristics. There is no guarantee the sample product or images will 100% match the product received. Engineered quartz is subject to variations in color, shade, grain, sizing, veining, movement, surface texture and finish. Such variations do not constitute a defect. We reserve the right to make changes to product specifications at any time without notice.

It is the sole duty and onus of the Purchaser and/or End User to inspect and approve all products upon receipt and prior to fabrication and installation. Any damage to the product thereafter is the responsibility of the Purchaser and/or End User. If, during initial inspection the Purchaser and/or End User believe the Revera™ slab possesses incorrect color/shading, finish, sizing, grading, gloss level, and/or any other characteristic, the product should NOT be installed. End User is responsible for ensuring proper fabrication, installation, application, care and maintenance of Revera™ slabs.

Exclusions from Warranty

Certain factors are beyond the control of Bedrosians®, including but not limited to transportation, fabrication, installation, building structure design, and environmental conditions.

  1. This limited warranty does not apply if Revera™ has been moved from its original installation location;
  2. This limited warranty does not cover Revera™ seam performance and/or appearance, adhesives, caulk, or other accessory items;
  3. This limited warranty is void if there is improper seam placement, such as over a dishwasher or trash compactor;
  4. This limited warranty does not cover alterations to the factory finish or slab thickness;
  5. This limited warranty does not cover mishandling, misuse, physical/chemical abuse, inappropriate use of cleaning solvents/products, or exposure to excessive moisture;
  6. This limited warranty does not cover fading or discoloration from exposure to ultra violet rays and/or light;
  7. This limited warranty does not cover cracks or chips resulting from excessive pressure or loading applied from a person or object;
  8. This limited warranty does not cover normal “wear and tear” or normal fading and discoloration;
  9. This limited warranty does not cover improper maintenance and/or failure to follow Revera™ Care and Maintenance Guide;
  10. This limited warranty does not cover defective or improper transportation, fabrication, installation, or workmanship by any person subsequent to receipt of product by the original Purchaser from a Bedrosians® facility;
  11. This limited warranty does not cover abnormal and/or creative use of material, including curving or bending;
  12. This limited warranty does not cover spots or blemishes inherent in the manufacturing process not effecting the structural stability of Revera™
  13. This limited warranty does not cover variations in shade, color, size, or pattern and shade distribution against the sample material, marketing displays, and/or printed illustrations;
  14. This limited warranty does not cover products exposed to excessive heat or thermal shock;
  15. This limited warranty does not cover products installed in any outdoor or exterior applications, including partially covered or sheltered outdoor areas. Exposure to weather, changing temperatures, sunlight and other conditions may damage the product;
  16. This limited warranty does not cover product installed to any outdoor applications;
  17. This limited warranty does not cover products installed in sink, steam shower, or steam room and sauna applications;
  18. This limited warranty does not cover products installed in vehicles, aircraft, or watercraft applications;
  19. This limited warranty does not cover scratches or damage to the surface of the product after the product leaves a Bedrosians® facility. This material is highly scratch resistant but not scratch proof. Proper care must be exercised including the use of a cutting board as part of your care and maintenance;
  20. This limited warranty does not cover End User dissatisfaction with the color or surface finish of Revera™ during or after installation;
  21. This limited warranty does not cover products installed with insufficient room for expansion;
  22. This limited warranty does not cover products directly secured with mechanical fasteners;
  23. This limited warranty does not cover products installed with improper or insufficient support, cabinets, structures, substrate, or sub-floors, causing failure;
  24. This limited warranty does not cover chips or cracks that result from “dry” cutting or polishing;
  25. This limited warranty does not cover mitered edges where the joint is not cut correctly;
  26. This limited warranty does not apply if the minimum requirements for edge detail were not followed;
  27. This limited warranty does not cover improperly cut joints;
  28. This limited warranty does not cover water marks, stains, or markings caused by daily living;
  29. This limited warranty does not cover products installed with aerosol catalyst adhesives;
  30. This limited warranty does not cover products installed with oil-based adhesives;
  31. This limited warranty does not cover damage or injury caused by any act of God, vandalism, war, accidents, or site conditions;
  32. This limited warranty does not cover any supplemental expenses incurred to repair or replace Revera™ including but not limited to electrical, plumbing, cabinetry, resurfacing, and tile or wall surface modification. Such repair and modifications shall be at the cost of the Revera™ End User. This limited warranty does not cover any other product used or installed whether or not in connection with Revera™;
  33. This limited warranty does not cover transportation, freight, tear-out, demolition in any form, disposal, reinstallation, fabrication, or associated costs beyond the cost of the product or its replacement;
  34. This limited warranty does not cover Revera™ product sold by unauthorized resellers or product sold by authorized resellers outside their authorized territory without the express written consent of Bedrosians®;
  35. This limited warranty does not apply if End User refuses to allow inspection of the alleged manufacturing defect by a Bedrosians® representative or, at Bedrosians®’ option, a thirdparty representative;
  36. This limited warranty does not cover improper selection of Revera™ for the installation or design, engineering, and construction of the installation site. Such determinations are strictly the End User’s responsibility

Procedure for Making a Claim:

  1. The Purchaser of Revera™ by Bedrosians® must register the product at www.bedrosians.com within thirty (30) days of the purchase date from Bedrosians® as indicated on the Bedrosians® invoice. Failure to register the product within the designated timeframe shall be deemed a waiver and time bar for any and all warranty-related claims against Bedrosians®.
  2. The Purchaser must provide Bedrosians® prompt written notice within ten (10) days of alleged defect discovery. The immediate and direct Purchaser’s failure to file a claim with complete information within ten (10) days shall be deemed a waiver and time bar for any and all warranty-related claims against Bedrosians®. Commercial Warranty

This warranty is subject to the procedures, recommendations, limitations, disclaimers and exclusions mentioned herein and in the general information, installation limitations and warranty sections of this document. The flooring products carry a limited warranty against manufacturer and workmanship defects when used under normal conditions and installed in accordance with Manufacturer/Distributor’s installation instructions to the original Owner/Purchaser/ Installer of the product, if they are the original purchaser where the product is installed for the period of the warranty

Note: You must retain an original label of the product purchased which denotes your warranty duration. This warranty is nontransferable. Manufacturer/Distributor’s warranty and liability does not extend beyond the flooring strips and is limited to a maximum value of the original purchase price of the flooring. Warranty is limited to repair or replacement of the flooring strips at the sole option of the Manufacturer/Distributor. The warranty does not include labor and installation costs. Claim compensation, if approved and/or authorized is limited to the specific area which the Manufacturer/Distributor deems to be valid under the claim.

Product warranty use and limitation definitions are:

  • Residential warranty is limited to dweller owned and occupied single family homes that are owned during the warranty period.
  • Usage limitations are further defined herein.
  • This warranty does not cover and specifically excludes such damages as: indentations, scratches, dents, pet damages and stains caused by normal wear and tear, sheen loss in high traffic areas, erosion, pebbles, stones, sand, all other abrasives, inadequate protection, mold, mildew, bacteria, lack of maintenance, weather conditions, fire, water, natural disasters, excessive heat, heating and air-conditioning systems, accident, improper installation or handling, cleaning, negligence or other causes not attributed to manufacturing or workmanship defects or failure to adhere to and follow all the manufacturer’s instructions for installation and maintenance and incorrect or insufficient maintenance.
  • Any modification to the product other than as outlined in the manufacturer’s installation instructions will render the warranty null and void.
  • Thiswarranty excludes variances in, loss of sheen and changes to gloss levels.
  • This warranty excludes noises of all types (creaks, squeaks, etc.) emanating from the floor and/or subfloor.
  • Expansion of the floor caused by sunlight and/or excessive temperatures is not considered a defect under this warranty.
  • This warranty excludes claims due to differences in the color and character from display models, physical samples, website/literature/ advertising images, as well as differences in color and character from plank to plank, except as noted herein.
  • The warranty excludes claims due to natural changes in color from exposure to light, or to areas which have not changed in color due to less exposure to light than surrounding areas.
  • This warranty shall be void if visual defects or nonconformities are determined to be apparent prior to installation.
  • This warranty explicitly excludes products sold “as is”.
  • Color & manufacturing flaws up to 5% are not considered as manufacturer’s defects under this warranty.
  • Damages to the floor caused by heavy rolling loads, industrial and commercial handling equipment, or furniture, such as chairs with castors of any type, are specifically excluded from this warranty.
  • Damages to the floor caused by improperly moving appliances, and other types of large or heavy objects are specifically excluded from this warranty.
  • The original Installer is responsible for a correct installation, the original Owner/Purchaser is responsible for the correct maintenance and cleaning of the flooring in accordance with the included instructions.
  • All warranty claims must be reported immediately. Failure to report the warranty claim within 30 days of defect discovery will void the warranty.

This warranty specifically excludes claims for damages attributed to in-floor (radiant) heating systems, or damages caused by heat released by or escaping from heating ducts, sunlight, heating vents or electric baseboards and hot water heating system registers and in all cases where temperatures have exceeded 90°F.

This warranty excludes flooring exposed to moisture, alkaline, acids, solvents, surface stains including asphalt, driveway sealers, rubber wheels, rubber and latex mats, extended exposure to direct sunlight, extremes of temperature, chemical reaction, corrosion, cuts, scratches, scrapes, loss of gloss, casters, wheels, heavy rolling loads, lifts and/or equipment, non-foot traffic or from any abuse or abnormal use.

This warranty excludes material not from the same production run.

This warranty excludes results: health hazards, structural damages and mold and mildew growth. Limited waterproof claim does not cover any structural, mold and/or mildew damages.

The Manufacturer/Distributor warrants to the original user that the wear-layer on this product will not wear through nor separate from the flooring during the warranty period when installed and used under normal residential use in accordance with the terms, installation instructions, limitations and conditions herein.

Should this floor fail to live up to the provisions of this warranty, the Manufacturer/Distributor, at its sole option, to the original purchaser/ home owner, will repair or replace the area it deems to qualify under the warranty claim at no cost to the original purchaser/home owner with the same or similar product. If the repair or replacement by a same or similar product cannot provide a reasonable and satisfactory claim resolution, the Manufacturer/Distributor, at its sole option may elect to provide to the original purchaser/ homeowner a refund of the original price of the materials for the affected area only. This warranty is the entire and sole statement of warranty for the product and replaces any and all previous warranties, written, spoken, implied or otherwise. No implied warranties exist beyond the terms and conditions of this warranty, the Manufacturer/ Distributor assumes no legal liability for any and all actual incidental and/or consequential damages, however, some states and provinces do not permit the exclusion or limitation of incidental and/or consequential damages, as such, this exclusion may not apply to you. This like all warranties gives you specific legal rights; in addition, you may also have other rights that vary from state to state. To file a warranty claim, first contact the original dealer where the floor was purchased. Note that the Manufacturer/ Distributor reserves the right to visit or have its agent visit the premise where the product claim originates to inspect the product in dispute and to remove samples for verification and technical analysis. Failure to provide reasonable access to the installation area or to provide requested information and/or documentation may result in denial of the claim.

All warranty claims must be made through the dealer that you purchased your floor from. All claims must include a complete copy of the original purchase receipt, installation documentation and information, site photographs and other information that may be requested by your dealer, the distributor and/or the manufacturer.
